Drug Possession Laws & Penalties

In California, drug possession refers to the act of having illegal drugs or controlled substances in one's possession without a valid prescription or legal authorization.

To establish drug possession, the prosecution must prove that the defendant had physical control or custody over the drugs and knew of their presence.

Possession can be either actual or constructive:

  • Actual possession: This occurs when the drugs are found on the person, such as in their pockets, hands, or bag. The individual has direct physical control over the drugs.
  • Constructive possession: This occurs when the drugs are not on the person but are within their reach or under their control. For example, if drugs are found in the defendant's car or in a locker that they have access to, it can be considered constructive possession.

California law classifies drugs into different schedules, with Schedule I drugs considered the most dangerous and Schedule V drugs considered the least dangerous. Common drugs such as cocaine, heroin, methamphetamine, LSD (acid), and MDMA (ecstasy) fall under various schedules.

Simple drug possession (for personal use) is considered a misdemeanor offense. A conviction carries a maximum jail sentence of one year and/or a fine of up to $1,000. Offenders may be eligible to enter a drug treatment program in lieu of jail time.
