Attorney Scott Bentley Argued Case in Appellate Court in Ventura

Attorney Scott Bentley recently argued a case in the Court of Appeal in Ventura, CA.

He was assigned to People v. Boothe (Court of Appeal Case No. B293913) to represent the appellant by the California Appellate Panel. Attorney Bentley appealed felony convictions for attempted second degree commercial burglary and conspiracy to commit second degree commercial burglary.

Since the main piece of evidence in the case was a surveillance video, Attorney requested the footage be transmitted to the Court of Appeal under California Rules of Court Rule 8.224. Under this rule, a party who wishes the applicable court to review an exhibit must file a notice in the superior court—which designated the exhibit in question—within 10 days after the last respondent’s brief is filed.

The appellant’s opening brief in the case was filed on April 19, 2019. After the Attorney General’s respondent’s brief was filed on May 17, Attorney Bentley filed an appellant’s reply brief on June 6.

The Second District Court of Appeal, Division Six in Ventura heard oral arguments between both parties by a panel of three appellate justices. Afterward, the case was submitted to the court.
